By downloading, installing, or using the Noirlife mobile application or website, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, do not use our Services. These Terms apply to all visitors, users, and others who access or use Noirlife.

    2. Eligibility

    You must meet the following criteria to use Noirlife:

    • You must be at least 18 years of age.
    • You must be legally permitted to consume alcohol in your jurisdiction.
    • You must provide accurate and complete information during registration.
    • You must not have been previously suspended or removed from the Noirlife platform.
    3. Description of Services

    Noirlife provides the following features and services:

    • BAC Level Checker: Estimates your blood alcohol content based on inputs you provide.
    • AI Drink Intelligence (Ask Noir): AI-powered drink safety insights, ingredient information, and recovery guidance.
    • Drink & Water Logging: Tools to track your alcohol and hydration intake during a night out.
    • SOS Alerts: One-tap emergency alerts sent to your designated contacts.
    • Destination Lock: Route monitoring that alerts your emergency contacts if your journey deviates unexpectedly.
    • Safety Spots: Discovery of trusted safe locations near your current position.
    • Memories: A personal space to save photos and notes from your nights out.
    4. Health & Safety Disclaimer

    Noirlife is a personal safety companion tool and does not constitute medical advice. You acknowledge and agree that:

    • BAC estimates provided by the app are approximations based on the Widmark formula and user-provided inputs. They are not a substitute for professional medical assessment or a certified breathalyser.
    • AI drink insights are for informational purposes only and should not be relied upon as medical, legal, or professional advice.
    • Noirlife does not encourage excessive alcohol consumption. Use of our BAC and drink logging features is solely to promote awareness and safer decision-making.
    • You assume full responsibility for your personal safety and decisions made while using the app.
    • In a medical emergency, always contact your local emergency services first.
    5. Emergency Contact & SOS Features

    When using SOS Alerts or Destination Lock, you agree to the following:

    • You are responsible for obtaining explicit consent from any individual you designate as an emergency contact.
    • Noirlife will share your location and safety status with your designated contacts when an alert is triggered.
    • Noirlife is not liable for failure to deliver alerts due to network outages, device limitations, or incorrect contact information.
    • SOS and Destination Lock features are supplementary safety tools and do not replace emergency services such as calling 911 or your local equivalent.
    6. User Responsibilities

    As a user of Noirlife, you agree to:

    • Use the app only for its intended, lawful purposes.
    • Provide accurate information for features such as BAC tracking, emergency contacts, and Destination Lock.
    • Not misuse the SOS feature by sending false or unnecessary alerts.
    • Not attempt to reverse-engineer, decompile, or tamper with the Noirlife app or its backend systems.
    • Not use the platform to harass, harm, or deceive other users or third parties.
    • Maintain the security of your account credentials and notify us immediately of any unauthorized access.
    7. User-Generated Content

    Noirlife allows you to save photos and notes as personal memories. With respect to this content, you agree that:

    • You retain ownership of any content you upload or create within the app.
    • You grant Noirlife a limited, non-exclusive licence to store and display your content solely for the purpose of providing the Memories feature to you.
    • You are solely responsible for the content you save and must ensure it does not violate any applicable laws or third-party rights.
    • You may delete your memories at any time from within the app.
    • Noirlife does not review or moderate personal memory content but reserves the right to remove content that violates these Terms.
    8. Intellectual Property

    All content, design, code, branding, logos, and features within the Noirlife app and website are the intellectual property of Noirlife and are protected by applicable copyright and trademark laws. You agree that:

    • You will not copy, reproduce, distribute, or create derivative works from any part of our Services without prior written consent.
    • The Noirlife name, logo, and brand assets may not be used without explicit permission.
    • Feedback or suggestions you provide may be used by Noirlife to improve the product without any obligation to compensate you.
    9. Third-Party Services

    Noirlife integrates with third-party services to power certain features. These include:

    • OpenAI (GPT-4o) for the Ask Noir AI chat feature.
    • Google Maps & Places API for Safety Spots and location-based services.
    • Cloudinary for media storage.
    • Push notification providers for SOS and safety alerts.
    10. Limitation of Liability

    To the fullest extent permitted by applicable law, Noirlife and its founders, employees, and affiliates shall not be liable for:

    • Any indirect, incidental, special, or consequential damages arising from your use of the app.
    • Personal injury, harm, or loss resulting from reliance on BAC estimates, AI insights, or safety features.
    • Failure of SOS or Destination Lock alerts due to connectivity issues, device failure, or incorrect contact information.
    • Loss or corruption of your personal data, memories, or account content.
    • Any actions or omissions of emergency contacts you designate within the app.
    11. Account Termination

    Noirlife reserves the right to suspend or permanently terminate your account at any time if you:

    • Violate any provision of these Terms and Conditions.
    • Misuse safety features such as SOS in a fraudulent or harmful manner.
    • Engage in behaviour that endangers other users or third parties.
    • Provide false information during registration or app use.
    12. Changes to These Terms

    We may update these Terms and Conditions from time to time. Any changes will be posted within the app and on our website with a revised "Last Updated" date. Continued use of Noirlife after changes are posted constitutes your acceptance of the updated Terms.

      13. Governing Law

      These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from or related to these Terms or the use of Noirlife shall be subject to the exclusive jurisdiction of the courts located in Nigeria, without prejudice to any mandatory consumer protection rights you may have under your local law.
